These Terms and Conditions ("Terms") govern your purchase and use of any programmes, coaching, consulting, workshops, masterclasses, events, digital products, courses, downloadable resources and other services ("Company Services") provided by Wildon Consultancy Ltd, trading as Success Breakthrough Coaching ("the Company", "we", "us" or "our").

By purchasing, booking, enrolling in, accessing or participating in any Company Services, whether paid for or provided on a complimentary basis, you ("the Client", "you" or "your") confirm that you have read, understood and agree to be bound by these Terms.

If you do not agree to these Terms, you should not purchase, access or participate in any Company Services.

 

1. Definitions

For the purposes of these Terms:

Company means Wildon Consultancy Ltd trading as Success Breakthrough Coaching.

Company Services means all coaching, consulting, programmes, workshops, masterclasses, courses, digital products, downloadable resources, live events, memberships, recordings, online communities and any other services provided by the Company, whether paid for or provided on a complimentary basis.

Client means any individual purchasing, booking, enrolling in or participating in any Company Services.

Digital Content means any videos, recordings, workbooks, templates, written materials, downloads, online resources, learning portals and any other digital materials supplied by the Company.

 

2. Company Services

Company Services are designed to provide education, coaching, personal development, business development, mindset support and energy based practices for educational, informational and personal development purposes.

Company Services are intended to support your personal and business growth and are not intended to replace medical treatment, psychological therapy, counselling, legal advice or financial advice.

Nothing within Company Services should be interpreted as medical, psychological, legal or financial advice, diagnosis or treatment.

You remain solely responsible for your own wellbeing, health, decisions and self care before, during and after participating in any Company Services.

To the fullest extent permitted by law, neither Wildon Consultancy Ltd, Success Breakthrough Coaching, Shilleen Wilson nor any member of our team accepts responsibility for any mental, emotional or physical outcomes arising from your participation, except where liability cannot legally be excluded.

Company Services provide education, guidance and support only. We do not guarantee financial outcomes, business success or any particular results.

The specific details, duration, inclusions and delivery method of each Company Service will be outlined on the relevant sales page, booking page, proposal or written agreement at the time of purchase.

Participation in Company Services does not create any partnership, joint venture, employment, agency or fiduciary relationship between you and the Company.

 

3. Eligibility

You must be at least eighteen years of age and legally capable of entering into a binding agreement to purchase or participate in Company Services.

By purchasing any Company Services you confirm that the information you provide is accurate and complete.

 

4. Fees and Payment

All prices are stated in Great British Pounds (GBP) and include applicable taxes unless stated otherwise.

Payment is required in full before access to Company Services is granted unless an agreed payment plan has been offered by the Company.

Payment plans are offered solely as a convenience to spread the cost of Company Services. Entering into a payment plan constitutes a binding commitment to pay the full agreed amount.

Payment plans are not subscriptions or memberships and cannot be cancelled because you choose not to continue participating, fail to complete the programme or decide not to use the remaining services.

You remain legally responsible for completing all scheduled instalments regardless of attendance, participation or completion.

If a payment is unsuccessful or becomes overdue, we reserve the right to suspend access to Company Services until your account has been brought up to date.

If payment issues arise, you agree to communicate with us promptly so that a reasonable resolution can be explored.

Where payment remains outstanding and no satisfactory resolution is reached, we reserve the right to recover any outstanding balance through appropriate legal means.

 

5. Refunds and Cancellation Rights

By purchasing Company Services you acknowledge that many of our services include Digital Content that is made available immediately after payment.

By completing your purchase you expressly request immediate access to this Digital Content and acknowledge that, where permitted by law, you waive any applicable cooling off rights relating to Digital Content once access has begun.

Except where required by applicable law, all sales are final.

No refunds, exchanges or transfers will be provided unless expressly agreed by the Company in writing.

If a specific Company Service has a different cancellation or refund policy, this will be clearly stated on the relevant sales page or booking information and will take precedence over this section.

Individual coaching sessions may be rearranged provided that at least twenty four hours notice is given.

Where less than twenty four hours notice is provided, or a session is missed without notice, the Company reserves the right to treat the session as delivered and it may be forfeited.

 

6. Session Expiry

Unless otherwise agreed in writing, any coaching sessions included within Company Services must be used within three months of the original scheduled completion date of the relevant programme or service.

Any sessions that remain unused after this period will automatically expire and cannot be carried forward.

Any extension to this period is entirely at the Company's discretion and must be confirmed in writing.

 

7. Digital Access

Access to Digital Content will be provided for the period stated on the relevant sales page or programme information.

Where lifetime access is offered, this refers to the lifetime of the relevant programme while it continues to be maintained by the Company and does not mean your lifetime.

From time to time we may update, improve, replace or remove content where reasonably necessary to improve Company Services, reflect changes in legislation, update information or improve the learning experience.

Where reasonably possible, replacement content of similar value will be provided.

 

8. Bonuses

From time to time Company Services may include complimentary bonuses.

The Company reserves the right to replace any bonus with another bonus of equal or greater value where reasonably necessary.

Where a bonus includes attendance at an event, retreat or live experience, unless expressly stated otherwise, travel, accommodation, meals, insurance and all associated personal expenses remain the responsibility of the Client.

Bonuses have no cash value and cannot be exchanged for alternative services or refunded.

 

9. Intellectual Property

All materials, content, videos, recordings, workbooks, written content, templates, tools, methods, frameworks, presentations, graphics, designs, downloads, resources and any other materials provided as part of Company Services remain the intellectual property of Wildon Consultancy Ltd trading as Success Breakthrough Coaching and or its licensors.

These materials are protected by copyright, trade mark and intellectual property laws.

Upon purchasing or participating in Company Services, you are granted a personal, non transferable, non exclusive licence to access and use the materials solely for your own personal learning or internal business use.

You may not copy, reproduce, modify, publish, distribute, share, licence, sell, upload, display, transmit or exploit any part of the Company Services or materials without our prior written permission.

You may not create derivative works, reproduce proprietary frameworks or methods, or use any of our materials for the purpose of teaching, training or delivering services to others without our written consent.

You are welcome to share your own personal experiences, insights and results gained through working with us, including testimonials, provided that you do not disclose confidential Company materials or reproduce our proprietary content.

Access to Company Services is provided solely for the individual who has purchased them. Login details, recordings, resources and programme access must not be shared with any other individual unless expressly authorised by the Company in writing.

 

10. Privacy, Data Protection and Confidentiality

Wildon Consultancy Ltd trading as Success Breakthrough Coaching is committed to protecting your privacy and handling your personal information responsibly.

We process personal information in accordance with the United Kingdom General Data Protection Regulation, the Data Protection Act 2018 and any other applicable data protection legislation.

Information that you provide to us will be used only for purposes connected with delivering Company Services, communicating with you and meeting our legal and business obligations.

Where you voluntarily provide health or wellbeing related information, this will be treated as sensitive personal data and processed only where appropriate and in accordance with applicable data protection legislation.

We respect the confidentiality of information shared with us and will not disclose confidential information except:

where required by law

where you have provided your consent

where disclosure is necessary to protect the rights, property or safety of the Company, our team or others

Where Company Services include group programmes, workshops, masterminds or community spaces, all participants are expected to maintain the confidentiality of information shared by other members.

You agree not to share, reproduce or disclose confidential or personally identifiable information relating to other participants outside of the relevant Company Service without their express permission.

As confidentiality cannot be guaranteed where third party platforms are used, you acknowledge that while we take reasonable steps to protect information shared within Company Services, we cannot guarantee the actions of other participants.

We may collect additional information that is necessary to deliver specific Company Services. For example, where you purchase a Unique Energy Blueprint Reading, we may collect your date of birth, time of birth and place of birth in order to prepare and deliver your reading. This information will only be used for the purpose for which it was collected unless otherwise required by law.

 

 

10A. Marketing Communications

By purchasing or participating in Company Services, you acknowledge that the Company may contact you by email regarding your purchase, your participation in Company Services and other relevant business communications.

Where permitted by applicable law, we may also send you information about similar products, services, offers, events and educational content that we believe may be of interest to you.

You may unsubscribe from marketing communications at any time by clicking the unsubscribe link included in our emails or by contacting us directly. Unsubscribing from marketing communications will not affect essential emails relating to any Company Services you have purchased

 

11. Recording, Photography and Promotional Use

To support learning and provide continued access, live coaching sessions, workshops, masterclasses and other Company Services may be recorded.

Recordings may be made available to participants as replays and may also be used for internal training and quality improvement purposes.

All recordings remain the property of Wildon Consultancy Ltd trading as Success Breakthrough Coaching.

From time to time, photographs and video footage may also be taken during live events, workshops or other Company Services.

These photographs and recordings may be used for promotional, educational and marketing purposes, including on our website, social media platforms and other marketing materials.

If you do not wish to appear in photographs or promotional recordings, you should notify the Company in writing before the relevant event wherever reasonably possible and we will make reasonable efforts to accommodate your request.

 

12. Third Party Platforms and Websites

Company Services may include access to or use of third party platforms including, but not limited to, Zoom, WhatsApp, Telegram, Voxer, online learning platforms and other communication tools.

These platforms are provided for convenience and to support delivery of Company Services.

The Company does not own or control these third party platforms and accepts no responsibility for their availability, security, policies, content or performance.

Where Company Services include links to third party websites, resources or services, these are provided solely for your convenience and do not constitute endorsement by the Company.

Your use of any third party website or platform is entirely at your own risk and subject to that provider's own terms and conditions and privacy policies.

 

13. Technology

While we make every reasonable effort to provide uninterrupted access to Company Services, we cannot guarantee that online services will always be available.

Occasionally, interruptions may occur due to circumstances beyond our reasonable control, including internet outages, software failures, platform maintenance, technical faults or failures of third party providers.

The Company will not be liable for any temporary interruption, delay or inability to access Company Services arising from these circumstances.

Where reasonably possible, we will take appropriate steps to restore access or provide alternative arrangements.

 

 

 

 

14. Client Responsibilities

Your success within Company Services depends upon many factors, including your commitment, effort, implementation, willingness to take action, previous experience, personal circumstances and decisions.

You acknowledge and agree that you remain solely responsible for:

your own decisions and actions

your participation and implementation

your physical, emotional and mental wellbeing

seeking appropriate professional advice where required

the results you achieve from Company Services

While we are committed to providing high quality coaching, guidance, education and support, we do not guarantee any specific business, financial or personal outcomes.

You accept full responsibility for applying the information, tools and guidance provided during Company Services and understand that results will vary between individuals.

 

15. Community Standards

Where Company Services include group programmes, online communities, workshops, events or collaborative environments, all participants are expected to contribute to a respectful, supportive and professional environment.

You agree not to engage in behaviour including, but not limited to:

bullying or harassment

discrimination or abusive behaviour

intimidation or threatening conduct

sharing confidential information belonging to other participants

unauthorised promotion or solicitation of products or services

behaviour that disrupts or negatively impacts the experience of others

Failure to comply with these standards may result in suspension or removal from Company Services without refund where we deem to be appropriate.

 

16. Right to Refuse Service

The Company reserves the right to refuse or decline participation in any Company Services where we reasonably believe that the services are not suitable for an individual's needs or where participation may adversely affect the experience, wellbeing or safety of other participants.

We also reserve the right to refuse future bookings from individuals who have previously breached these Terms or behaved in a manner that is abusive, threatening or otherwise inappropriate towards the Company, members of our team or other participants.

 

17. Disclaimer

Company Services are provided for educational, informational and personal development purposes only.

While every reasonable effort is made to provide high quality coaching, guidance, education and support, Wildon Consultancy Ltd trading as Success Breakthrough Coaching does not make any guarantees or warranties regarding the results, success or outcomes that you may achieve.

Every Client is different and results will vary depending upon many factors including, but not limited to, your commitment, effort, skills, previous experience, personal circumstances, decisions and willingness to implement the guidance provided.

You acknowledge and agree that you are solely responsible for your own decisions, actions and results.

Nothing contained within Company Services should be interpreted as medical, psychological, therapeutic, legal, financial or investment advice.

You agree to obtain independent professional advice where appropriate before making decisions relating to your health, finances, legal matters or business.

Testimonials, case studies and examples shared by the Company represent the experiences of individual Clients. They are provided for illustrative purposes only and should not be interpreted as a promise or guarantee that you will achieve the same or similar results.

Participation in Company Services is entirely voluntary and undertaken at your own discretion.

 

18. Limitation of Liability

To the fullest extent permitted by applicable law, Wildon Consultancy Ltd trading as Success Breakthrough Coaching, its directors, employees, contractors, representatives and associates shall not be liable for any indirect, incidental, consequential or special loss or damage arising from or connected with your participation in Company Services.

This includes, but is not limited to:

loss of income

loss of profits

loss of business opportunities

business interruption

reputational damage

emotional distress

indirect financial loss

Nothing within these Terms excludes or limits liability where such exclusion or limitation would be unlawful.

To the fullest extent permitted by law, the Company's total liability arising from any claim relating to Company Services shall not exceed the amount paid by you for the specific Company Service giving rise to the claim.

 

19. Force Majeure

The Company shall not be responsible for any delay, interruption or failure to perform its obligations where such delay or failure arises from circumstances beyond its reasonable control.

These circumstances include, but are not limited to:

illness

accident

natural disasters

severe weather

fire

flood

government restrictions

public health emergencies

war

civil unrest

industrial disputes

industrial action

utility failures

power failure

internet or communication failures

technical issues

cyber attacks

failure of third party suppliers

public transport disruption

traffic delays

travel disruption, strikes, transport cancellations

or any other event beyond our reasonable control.

Where reasonably possible, we will make reasonable efforts to rearrange Company Services or provide an alternative solution.

 

20. Termination

The Company reserves the right to suspend or terminate your access to any Company Services, without refund where appropriate, if you:

breach these Terms

fail to make agreed payments

engage in abusive, threatening or inappropriate behaviour

repeatedly disrupt Company Services

misuse Company materials

breach confidentiality

engage in unlawful activity in connection with Company Services

Termination of your participation does not remove your obligation to complete any outstanding payment commitments.

Any provisions of these Terms that are intended to survive termination, including those relating to intellectual property, confidentiality, limitation of liability and governing law, shall continue to apply after your participation ends.

 

21. Assignment

Your place within Company Services, together with any associated rights, licences or access, is personal to you.

You may not transfer, assign, sell or otherwise pass your place, programme access, recordings, resources or any other rights under these Terms to another person without the prior written agreement of the Company.

 

22. Severability

If any provision within these Terms is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision shall be interpreted as closely as possible to reflect its original intention.

The remaining provisions shall continue in full force and effect.

 

 

 

 

23. Waiver

If the Company chooses not to enforce any provision of these Terms on one occasion, this shall not prevent the Company from enforcing that provision or any other provision at any future time.

Any waiver must be confirmed by the Company in writing.

 

24. Governing Law and Jurisdiction

These Terms and any dispute or claim arising from them or relating to Company Services shall be governed by and interpreted in accordance with the laws of England and Wales.

The parties agree that the courts of England and Wales shall have exclusive jurisdiction in relation to any dispute arising from these Terms.

 

25. Changes to these Terms

The Company reserves the right to amend, update or revise these Terms from time to time where reasonably necessary.

The most recent version will be made available through our website or provided upon request.

Your continued purchase, access to or participation in Company Services following any update constitutes your acceptance of the revised Terms.

 

26. Entire Agreement

These Terms constitute the entire agreement between you and Wildon Consultancy Ltd trading as Success Breakthrough Coaching in relation to Company Services.

They replace any previous discussions, representations, communications or agreements relating to the same subject matter.

No verbal statement, promise or representation made by the Company or any member of our team shall form part of these Terms unless confirmed by us in writing.
